The landscape of food and quick-commerce delivery in Maharashtra is set for a monumental shift. In a major move to regulate the booming gig economy and safeguard driver interests, the Maharashtra government is drafting comprehensive changes to its Bike-Taxi Rules. These amendments will explicitly pull food and grocery delivery giants like Swiggy, Zomato, Blinkit, and Zepto under the state’s regulatory umbrella for the first time.

Historically, while ride-hailing services like Ola, Uber, and Rapido were strictly governed by the state’s 2026 Aggregator Rules, delivery platforms operated in a gray area. They functioned primarily under broader national guidelines, such as the Consumer Protection Act and the Code on Social Security. Now, the state’s transport department, led by Minister Pratap Sarnaik, aims to redefine any company operating vehicle fleets for parcels and packages as a “delivery service provider”.

The Push for an All-Electric Fleet

For delivery partners, the most immediate operational change will be the transition to electric vehicles (EVs). Under the proposed draft regulations, delivery companies will be mandated to switch entirely to electric two-wheelers for all deliveries. Minister Sarnaik confirmed that this revised policy is designed to cover all bike rides of up to 15 kilometers—which easily encompasses the vast majority of standard quick-commerce and food delivery operations.

While a greener fleet is excellent for urban pollution levels, it raises immediate questions regarding the financial burden on delivery partners who currently use petrol-powered motorcycles. To mitigate this, the platforms will need to facilitate the transition, potentially through structured EV rental programs, subsidized loan tie-ups, or enhanced payout structures for EV riders.

The 2% Welfare Fund: A Safety Net for Riders

Perhaps the most significant victory for gig workers in this draft is the introduction of a mandatory welfare corpus. The proposed rules stipulate that platforms must contribute a 2% share of every single fare into a dedicated welfare fund.

Beyond EVs and welfare, the draft regulations are heavily focused on operational transparency and rider safety. Crucially, these platforms will also have to adhere to fare caps established by the Regional Transport Authority (RTA). This could prevent arbitrary fluctuations in base pay and ensure a more stabilized, predictable income stream for delivery partners working across Mumbai, Pune, Nagpur, and other Maharashtrian cities.

What Happens Next?

While the drafted changes represent a massive leap forward for gig worker rights, they are not yet law. The fleet electrification mandates and the 2% welfare compliance requirements will only come into effect after the proposed amendments receive official state approval. However, with similar gig-worker welfare acts making headlines in Karnataka and Telangana this month, it is clear that state governments are actively closing the regulatory gaps.
